At Your Service – English Process Agents

Tremark are willing and able to act as an ‘English Process Agent’ for foreign based companies and individuals.
For those not familiar with the term, it basically means that we’re in a position to act as an official conduit for transactions governed by English law, where one of the parties doesn’t have a physical presence in the country. In effect, we become the nominated agent for the absent party and can provide a vitally important point of contact during the course of any legal proceedings.
Saving time and money
It’s become increasingly common for companies entering into an agreement or contract subject to English law, and not domiciled in England or Wales, to be required to provide an English address to which the courts can serve notice of legal proceedings on their behalf. It’s not just a mail forwarding service, though. In its role of process agent, Tremark will ensure notices are properly served, forwarding them quickly and efficiently by email, fax or Royal Mail.
For instance, let’s say a company or indiviual in France takes out a bank loan that’s governed under English law. The lender may well require the borrower to appoint a process agent in England so they have a UK-based point of contact in the event that court proceedings become necessary.
Under procedures issued in an English court, papers must be served in order to start legal proceedings correctly. If the party doesn’t have an address in England or Wales, the procedure for serving legal papers can be costly and time consuming. In the role of process agent, we will enter into a contract to accept service of notices, proceedings or documents on behalf of our overseas where it’s not possible or practical for them to be served abroad.

We’ve developed a selection of flexible packages and payment options so you can choose the most appropriate and cost-effective solution for your needs. Our standard turnaround time is two to three working days, though, in practice, many facilities are established even more promptly. Where time is of the essence, we can offer a guaranteed same-day service for an additional fee.
Options include an annual service, renewable each year or a fixed period service for the period of an agreement. We’ve created a simple form to record details of the extent and period of the agreement and which can be quickly processed. You’ll receive a letter of confirmation along with an invoice – and that’s pretty much that. An annual agreement will be renewed each year until cancellation and the only extra fees chargeable would be for any additional services you may request.
