The main routes are taking control of goods under a county court warrant or, for most judgments of £600 or more, a High Court writ of control executed by enforcement officers; an attachment of earnings order against wages; a charging order over property; a third party debt order freezing bank funds; and an order to attend court for questioning. The right choice depends entirely on what the debtor has, which is why enforcement starts with intelligence.
Employed debtor with steady wages: attachment of earnings, which needs the employer identified. Property owner: a charging order secures the debt against the title, with a possible order for sale later. Trading business or asset rich individual: enforcement agents taking control of goods, where the High Court route via a writ of control is available for qualifying judgments of £600 or more that are not regulated consumer credit debts. Known bank with funds passing through: a third party debt order strikes at the balance directly. Each route has costs and limits your solicitors will advise on; the common denominator is that all of them presuppose facts about the debtor.
An asset trace report and, where relevant, employment tracing supply those facts: confirmed residence, property ownership, vehicles and business interests, employment indicators and adverse data. The court’s own tool, an order to obtain information under CPR Part 71, compels the debtor to answer questions, and the order itself must be served personally, which is work our servers carry out with the usual evidence.
Experienced creditors enforce in the order the evidence suggests will pay fastest, and revisit as circumstances change; a debtor uncollectable today may inherit, sell a property or find employment next year, and a periodic re-trace catches the moment.
